Thousands of lawsuits are currently pending on behalf of military service members and veterans who relied on 3M earplugs for hearing protection. Their lawyers argue that the company failed to warn these men and women of a product defect, one that could result in significant hearing loss when they were exposed to loud sounds on the battlefield or in training exercises.
At the very least, 3M may have shown indifference to the risk, according to punitive damages already awarded by some juries. Overseeing 230,000 of such cases, U.S. District Judge M. Casey Rodgers in December 2022 imposed sanctions on the company for “brazen abuse of the litigation process.”
